Model Terms

 

TERMS CONTAINED

The following are the standard terms and conditions between Black Label Models (the Agency) and you, the Model for representation by the Agency for all work obtained through the Agency. These terms apply to all dealings between the Agency and you, and contain the entire agreement between us regarding the matters contained herein and neither party shall be bound by any undertakings, representations, warranties, promises or the like not recorded herein. No alterations, cancellations, variation of or additions shall be of any force or effect unless reduced to writing and signed by a Director of the Agency.

 

UPDATING THESE TERMS AND CONDITIONS

the Agency may amend or alter these Terms and Conditions from time to time by notifying you via email and you agree that you will be bound by such new Terms and Conditions as they are amended.

 

PERIOD OF REPRESENTATION

the Agency will actively promote and represent you as your model agent from the date you join the agency until it is terminated in accordance with these terms. During this time the Agency will use its best endeavors to obtain you work.

 

BLACK LABEL MODELS IS YOUR AGENT

The Agency is your agent and represents you for work but is not your employer. Agreements for work are usually between yourself and the clients that the Agency manages on your behalf.

 

TAX & SUPERANNUATION

the Agency is not responsible for deducting tax or paying super in relation to wages of the Model. the Agency acts as your agent and it is your responsibility for accounting for tax and superannuation.

 

MONIES RECEIVED BY THE AGENCY ON YOUR BEHALF

You agree that Monies may be received by the Agency on your behalf. These payments are usually the gross income less any tax or superannuation deducted by the Client. For commercial modelling work it is important that you have your tax file number when you attend as failure to complete a Tax File Number Declaration Form prior to payment being made may result in the Marginal Tax Rate being retained for tax purposes.

 

CONTRACTS FOR WORK

Most commercial modelling assignments require the execution of a modelling contract between the client and the Model. You authorise the Agency, when required, to execute such contracts on your behalf as your agent. the Agency will only execute Model contracts on behalf of Models upon the Model having been advised of the important terms and the Model has confirmed their acceptance.

 

COMMISSIONS

You agree that the Agency may retain a commission of the gross wages earned you in relation to employment on all amounts earned by you where such work was introduced or was as a result of being introduced directly or indirectly by the Agency. Gross wages also includes any additional payments, rollovers, territory fees, bonuses, winnings or prizes directly or indirectly associated with such work.

 

PERPETUITY

the Agency is entitled to retain a commission on all work that the Model receives through the Agency that is a result of the Agency introducing the Model to the client. This clause is in perpetuity and includes any work the model may do for the client after terminating representation with the Agency if such work was a result of the Agency introducing the Model to the client.

 

PAYMENT FOR WORK

the Agency can only pay Models once payment has been received from the client. The Agency requires clients to pay either in advance, COD or within 7 days of receiving an invoice if they have an account with us.

 

CANCELLING REPRESENTATION

A Model may cancel or suspend registration with the Agency by notifying the Agency in writing by email of their decision to do so.  And, if only suspending, state the period required. the Agency may cancel representation of a Model if we believe the Model has committed misconduct in relation to work. This may include a Model not attending work when booked without advising the Agency or Client with reasonable notice or failing to attend work when booked without reasonable excuse. We may suspend your representation if we cannot get in contact with you via the telephone numbers you have provided. It is your responsibility to notify us of changes. Such notification should be done via email to the Agency. The Agency may cancel representation if the Model has remained suspended for longer than12 months.
